1. Overview
Citychat respects the intellectual property rights of others and expects users and third-party providers to do the same. In accordance with the U.S. Digital Millennium Copyright Act ("DMCA", 17 U.S.C. §512), we respond to notices of alleged copyright infringement.
2. Nature of Content on the Site
Citychat does not host, store, or upload live-stream content. All streams are embedded from or link to third-party providers. If your copyrighted work appears in a live stream, the primary point of contact is the originating provider (Chaturbate, BongaCams, etc.). Nevertheless, we will act on valid DMCA notices concerning material shown on Citychat.
3. Submitting a DMCA Takedown Notice
To file a notice, please provide a written communication (email is acceptable) that contains substantially the following elements, as required by 17 U.S.C. §512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works, a representative list of such works.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (URL of the model page on Citychat).
- Your contact information: name, address, telephone number, email.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
4. Where to Send Notices
Send DMCA notices to our designated agent through our contact page, marked "DMCA Notice" in the subject line.
5. Response Time
We aim to review valid notices within 48 hours and remove or disable access to infringing material where appropriate.
6. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and consent to jurisdiction of the federal district court where you reside (or where the service provider may be found).
- A statement that you will accept service of process from the party who filed the original DMCA notice.
7. Repeat Infringers
We terminate the accounts and access of users and providers who are found to be repeat infringers.
8. Misrepresentations
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing (or was removed by mistake) may be liable for damages. Do not submit false claims.
